General Terms and Conditions (GTC)

1. Subject Matter of the Contract
BRITS’ PASSION AG sells to business and private customers (hereinafter referred to as the “Customer”) the goods specified in the online shop or in written quotations, subject to the terms and conditions of delivery and sale (GTC) set out below.
2. Conclusion of Contract
The contract between the Customer and BRITS’ PASSION AG is only concluded upon the Customer placing an order and BRITS’ PASSION AG accepting that order. The Customer places the order via the internet. BRITS’ PASSION AG accepts the order by (a) sending the Customer an order confirmation (by fax, email or post) or (b) delivering the ordered goods (including a delivery note).
3. Product range
All information regarding the goods provided to the customer during the ordering process is non-binding. In particular, we reserve the right to make changes to design and technology that improve the functionality of a product, as well as to correct errors in descriptions, illustrations and price quotations. All technical information regarding individual products is based on the manufacturer’s specifications and is binding within this framework.
4. Terms of Payment
All catalogue prices are guide prices that are continuously adjusted to market conditions. They are quoted in Swiss Francs (CHF), inclusive of VAT, unpackaged and carriage forward ex warehouse Embrach, but including the SWICO fee (recycling fee). Transport and packaging costs are charged separately. BRITS' PASSION AG reserves the right to supply customers only against advance payment. Delivery shall take place upon receipt of the advance payment (credit card, bank transfer or cash payment).
5. Delivery Terms
The ordered products can only be shipped to an address in Switzerland. Provided they are in stock, the products will be delivered immediately to the address specified by the customer. Otherwise, a written order confirmation will be issued stating the expected delivery date. Delivery of the goods (ex works) is at the customer’s expense and risk, even in the case of partial deliveries. Claims for damage to the ordered goods will only be settled upon presentation of a certificate from the relevant carrier in the event of externally visible damage. Should an ordered product no longer be available at the time of delivery, BRITS' PASSION AG expressly reserves the right to replace the product with an equivalent product.
6. Retention of title
The delivered goods remain the property of BRITS' PASSION AG until full payment has been made. The company is entitled to make a corresponding entry in the retention of title register. If the customer defaults on payment of the purchase price, BRITS' PASSION AG is entitled to withdraw from the contract (notice of withdrawal) and to take possession of the goods.
7. Right of return
The customer has the right to withdraw from the contract within a period of 14 working days without giving any reason and to return the goods. Please return the delivered items undamaged, in working order, complete and in their original, undamaged packaging. Failure to meet the above conditions may result in additional costs, which we would like to avoid on the customer’s behalf. We therefore ask you to contact BRITS’ PASSION AG’s customer service before returning the goods.
8. Warranty and Liability
All products offered in the online shop are covered by a 24-month warranty from the date of purchase, unless a longer warranty period is explicitly stated for the respective product. Should a product have a defect, we ask our customers to report this in writing, if possible, within 14 business days of receiving the goods. After examination of the warranty claim, BRITS' PASSION AG will, at its discretion, repair or replace the product. If a repair or replacement is not possible, the customer will receive a corresponding credit note or be offered an equivalent replacement product. In some cases, it may be necessary to process warranty or repair services directly with the respective manufacturer. BRITS' PASSION AG will assist the customer with the necessary information where possible. The warranty does not cover damage caused by improper use, normal wear and tear, lack of maintenance, external influences, or unauthorized modifications or repairs. Any modifications or repairs made to the goods without the written consent of BRITS' PASSION AG may void the warranty. Should an inspection reveal that no warranty claim exists or the manufacturer rejects the warranty claim, BRITS' PASSION AG reserves the right to pass on any expenses incurred. To the extent permitted by law, BRITS' PASSION AG's liability is limited to intent and gross negligence. Liability for indirect damages, consequential damages, or lost profits is excluded. The customer's statutory warranty rights remain unaffected.
9. Intellectual Property
BRITS' PASSION AG reserves all rights to every design, text, and graphic on its website. Copying or any other reproduction of the entire website or parts thereof is permitted only for the purpose of placing an order with BRITS' PASSION AG. The name BRITS' PASSION AG, all page headers, navigation bars, graphics, and button icons are registered trademarks, service marks, or trademarks of BRITS' PASSION AG. All other trademarks, product names, company names, or logos cited on this website are the sole property of their respective owners. BRITS' PASSION AG retains ownership and copyright of all illustrations, drawings, calculations, and other documents. The customer requires the express written consent of BRITS' PASSION AG before disclosing them to third parties.
10. Data Protection
BRITS' PASSION AG treats personal data confidentially and in accordance with the applicable data protection regulations of Switzerland. Personal data is used exclusively for contract processing, customer support, order processing, delivery of goods, and handling inquiries. Where necessary for the performance of the contract, data may be transferred to commissioned service providers (e.g., shipping providers, payment providers, or IT service providers). Personal data is used only to the extent necessary for the provision of our services. It will not be shared with third parties for advertising purposes. In connection with the use of the online shop, technical data, cookies, and similar technologies may be used to ensure the functionality, security, and user-friendliness of the website, as well as to conduct statistical analyses. If the customer has expressly consented to receiving information, newsletters, or marketing communications, BRITS' PASSION AG may use the provided contact details for such communications. Consent can be withdrawn at any time with effect for the future. Detailed information on the processing of personal data, the rights of data subjects, and the technologies used is contained in the current privacy policy on the BRITS' PASSION AG website. Within the framework of applicable legal provisions, the customer has the right to access, rectification, restriction of processing, or erasure of their personal data.
11. Jurisdiction and Applicable Law
These Terms and Conditions and the contracts concluded on the basis of these Terms and Conditions are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Zurich.
12. Final Provisions
In respect of the sale of goods specified in the BRITS' PASSION AG online shop, the General Terms and Conditions in the version valid at the time the relevant contract is concluded shall apply exclusively. These terms and conditions shall apply in particular even if they differ from those of the customer. Furthermore, BRITS' PASSION AG reserves the right to amend these General Terms and Conditions at any time.
